US Judge Orders Release of Kilmar Abrego Garcia from ICE Detention

A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case stems from a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to face alien smuggling charges, he was detained in immigration custody.

In her decision, the court pointed out that the government lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
