The NBA legend Tells Court He Felt No Fear of the Racing Body in Antitrust Trial

Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, admitted that his competitive side and novelty within the sport emboldened his push for 23XI Racing to confront Nascar over alleged violations of antitrust rules.

Financial Stakes and a Competitive Drive

Jordan shared financial and corporate details of his 23XI team, revealing he invested $40m of his own funds into the Cup Series operation co-founded with business partner Curtis Polk and driver Hamlin.

“It fell to someone to act,” Jordan said during testimony. “I was a new person, I had no fear. I felt I could challenge Nascar as a whole. From my perspective, the sport it needed to be looked at from a different view.”

The Core Dispute: Charter Agreements and Renewal Demands

The heart of the case involves the expiration of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other major leagues with separately owned franchises, like the NBA’s Hornets or the NFL’s Panthers. The agreement was due to end in 2024 when Nascar insisted on teams renew their charters.

Jordan testified for about sixty minutes and left the court to a media frenzy, with onlookers and reporters vying for a view or a picture of the sports legend.

Spearheading the Fight

23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a operating model Jordan said is breaking the law to maintain excessive control.

For Jordan and and a fellow team representative, who preceded Jordan, are events from last September. Gibbs described a hectic and tense six hours where the sanctioning body informed teams they must sign a charter agreement extension. The document spanned 112 pages detailing pay for chartered teams and a guaranteed entry in Nascar-sponsored races.

Choosing Litigation

Jordan explained that 23XI and Front Row Motorsports concluded their only feasible option was to decline to sign that 112-page package and litigate the matter. All other teams agreed to the terms.

Jordan and co-owner Denny Hamlin approached Nascar about potential amendments or extension options. Nascar refused to engage, according to his testimony.

The Bottom Line: Winning

But in the end, the pushback against what he saw as a financially unsustainable model was driven by the familiar goal for Jordan: Success.

“Denny convinced me adding a third car improved our chances to win,” he testified, noting that he bought a third charter last year for $28 million amid the legal dispute. “So I took the plunge.”

Account from the Gibbs Family

Heather Gibbs detailed her request for permanent charters, submitted in a formal letter to Nascar. She said the pressure of the contract signing demand didn’t sit well.

She said, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but CEO Jim France refused the appeal.

“Don’t do this to us,” Gibbs recounted Joe Gibbs told Nascar’s leadership. She said France replied, “Whether I have 20 charters, I have 20. If I have 30, that’s the number.”
